Online sales of products of the brand "Garconne & Chérubin" by the company ASTRAZZ PROJECT SAS.

The present general terms of sales apply between:

ASTRAZZ PROJECT SAS (Trade name: Garçonne & Chérubin), with a capital of 20 000 euros, having its headquarters at the following address: 56, Quai Alphonse le Gallo - 92100 BOULOGNE- BILLANCOURT - PARIS. registered in France at the RCS of Paris under n°791 898 919, code NAF 4791B, publisher of the site www.garconne-et-cherubin.com

Referred below as: "ASTRAZZ PROJECT"

And:

Every person making a purchase on the website  www.garconne-et-cherubin.com

Referred below as: "the Customer"

The Customer declares to have the capacity to conclude the present contract that is to have the legal majority and not be under guardianship.

The order by the Customer implies the irrevocable agreement with the present general terms of sale.

The sale contract is submitted to the French legislation.

1. Validity of offers

The offers address only consumers having a delivery address in the countries where ASTRAZZ PROJECT assures the delivery via a transport service agency.

Products presented on the site are valid while stocks last. In case of debit related to the purchase of an unavailable article, ASTRAZZ PROJECT makes a commitment to pay off the Customer within 30 days. ASTRAZZ PROJECT makes a commitment to warn by e-mail the Customer who would have placed order of an unavailable article.

2. Presentation of products

L Products proposed in the sale are described and presented with the biggest possible accuracy. However, if errors or omissions were able to occur as for this presentation, the responsibility of ASTRAZZ PROJECT could not be committed.

Photos representing our products have only an indicative value. These photos, just like the texts illustrating the products, do not enter the contractual field.

ASTRAZZ PROJECT could, because of its suppliers, be delivering to the Customer an article of composition slightly different from the one described but that would in any case of equal or superior quality to the ordered article.

3. Price

The prices presented on the site or the online shop are definitive. They are indicated in Euros (€) or Pounds and governed by the French legislation. They are inclusive of all taxes including the VAT except for the Customers having a delivery address situated out of the European Union - in which case the prices are exclusive of tax.

They are guaranteed except in case of an error of typography or impression.

These prices exclude participation to the transport fees which stays to the charge of the customer, except in the case of a temporary or permanent special offer.

The prices can be modified at any time, without advance notice - in particular in case of change of fiscal or economic data. Articles will be charged based on the current price rates at the time of purchase.

4. Terms of payment

Our products are to be payed in Euros (€) or Pounds. Any banking charges caused by the payment are to the charge of the customer.

The delivered goods remain the property of ASTRAZZ PROJECT until the reception of the payment. The transfer of the risks takes place from the delivery of the goods.

We accept credit cards (CARTE BLEUE / VISA / MASTER CARD / AMERICAN EXPRESS) as well as PAYPAL. 

5. Acceptance of the offer

Any order placed on our online shop is equivalent to an express and irrevocable acceptance of the prices and the descriptions of products. The validation of the order by the Customer is worth acceptance of general terms of sale.

6. Invoice

The invoice is sent to the e-mail address indicated during the order. It is established according to the current price list at the time of order. ASTRAZZ PROJECT relieves of any responsibility related to typing errors.

7. Delivery - Transport

We ship for free to France only. For international shipping, costs start at 10€ for Europe and 20€ for the rest of the world.

Orders placed before 11am (GMT+1) from monday to friday are sent on this very day (except on public holidays). Orders placed after 11am are send the following day. These time limits are for information only and are subjected to effective reception of payment.

These deadline are provided for information only. The exceeding of those deadlines could on no account be held against ASTRAZZ PROJECT, nor could it give cause for the termination of the contract involved, a right to claim damages or a compensation of any sort.

The risks in transports are chargeable to the Customers as from the exit of the warehouse. The Customer will have to make sure the packaging is in good state and that the delivered goods are as per order so as to alert ASTRAZZ PROJECT in case of any anomaly. Observed irregularities are to be written down onto the delivery slip presented by the transporter and to be addressed by e-mail to : customers@garconne-et-cherubin.com within 48 hours.

Should the country of delivery not be part of the European Union, custom duties are chargeable to the Customer. ASTRAZZ PROJECT has no control over those fees as they are the full responsability of the Customer.

8. Right of Withdrawal

If one or more articles do not suit, the Customer has a deadline of 15 days as from the delivery date of the goods, to exercise the right to withdraw of his order. The postmark or the date of reception of the goods constitute the date of departure of this deadline. The return or the cancellation can concern all or part of the order.

For that purpose, the Customer has to connect to his account, then click "Orders history and Creation of returns ". He then has to select the concerned order and follow the instructions. The expenses of return are chargeable to the Customer, unless ASTRAZZ PROJECT delivered a product which turns out to be damaged or to different of the ordered article.

Les frais de retour sont à la charge du Client, sauf si ASTRAZZ PROJECT a livré un produit qui s’avère être endommagé ou différent de l’article commandé.

The refund is made under a maximum deadline of 30 working days as from the reception of the returned goods by re-credit on the bank card used during the purchase and after making sure the article and its packaging are in good state.

Astrazz Project proposes a first free product exchange for its customers in France, for a similar model. The conditions that are valid refunds also apply to exchanges. (deadlines, good state of the article and its conditioning, etc).

Exchanges of products purchased from outside France are not possible - only refunds.

Articles returned either damaged, incomplete, dirty or send back after 15 days as from the date of delivery will be neither taken back, nor paid off.

9. Obligations of the Parties :

ASTRAZZ PROJECT, in the case of acceptance of an order, makes a commitment to sell and to deliver to the Customer products ordered by the latter according to the modalities specified above.

ASTRAZZ PROJECT makes a commitment to verify that products are conform with the French regulations.

The Customer makes a commitment to indicate to ASTRAZZ PROJECT an address to which the delivery can be made. Providing information such as the name, address, telephone number and e-mail address collected for the purposes of the contract is compulsory. This information is essential for the processing and routing of the orders and the issuing of invoices. Providing incorrect information entails the non-validation of the order. In case of an error in the supply of this information, ASTRAZZ PROJECT could not be held responsible for the impossibility to deliver the product. In this case, the customer remains responsible for the payment.

In the case of a supply of an incomplete address entailing the impossibility for the service provider to deliver, the Customer will have to pay for the expenses of delivery corresponding to the forwarding of his order.

10. Personnal Data

The data collection of the Customer is necessary for the processing of the order. This information is strictly confidential and is intended only for ASTRAZZ PROJECT.

According to the data protection act of January 6th, 1978, the Customer has a right to access, modify, rectificate and delete the personal data concerning him. If the Customer wishes to exercise this right, he should write to ASTRAZZ PROJECT, 56, Quai Alphonse Le Gallo - 92100 Boulogne-Billancourt, France and indicate his name, first names and address.

ASTRAZZ PROJECT reserves the right to collect data on the Customer by the use of cookies to improve the personalized service intended for the Internet user.

11. Responsibility

ASTRAZZ PROJECT could not see its responsibility involved in case of inconveniences and damage relative to the use of the Internet network such as a break in the services, the presence of computer viruses or outside intrusions or more generally any cases qualified as force majeure by the courts.

12. Miscellaneous Requirements

The incapacity of one of the clauses of the present general terms of sales or particular conditions will not affect the application or the validity of the other clauses of general terms of sale. This clause will then be replaced by the closest possible arrangement.

Neither ASTRAZZ PROJECT, nor the Customer can be held responsible in case of contractual non-fulfillment consecutive to a case of absolute necessity namely - and without it being exclusive - in case of a war, riot, uprising, interruption of transport, problem of import, strike, shortage, fire, earthquake, storm, flood.

13. Applicable Law and Competent Court

The present general terms of sale are exclusively governed by the French law.

The commercial courts of PARIS are only competent in case of dispute or different concerning them.
